Data collected in the course of a matter

When we act for you we collect and hold the personal data needed to carry out your instructions, to comply with our professional and legal obligations, including the obligation to verify your identity under anti money laundering law, and to keep the records the Law Society requires. The legal bases for that processing are the performance of our contract with you, compliance with legal obligations, and our legitimate interests in running the practice and establishing or defending legal claims. Where a matter requires us to process special category data, for example medical information in a personal injuries claim, we do so on the basis that it is necessary for the establishment, exercise or defence of legal claims.

Job applications

If you apply for a position with the firm, or write to us speculatively about one, we hold your curriculum vitae, your covering note and any correspondence that follows for the purpose of considering your application. The legal bases for that processing are the steps taken at your request before entering into a contract of employment and our legitimate interests in recruiting staff. Applications are seen only by those involved in the decision, and we do not contact a current employer or a referee without your express agreement. If your application is unsuccessful we keep it for twelve months and then delete it, unless you ask us to keep it on file for longer.

Who receives your data

We share personal data only where the matter requires it or the law permits it, for example with counsel, expert witnesses, other parties' solicitors, courts and tribunals, the Property Registration Authority, the Revenue Commissioners and the Law Society. Service providers that process data on our behalf include our website host and forms provider, Wix.com Ltd, whose servers are located in the European Union and in other countries under the European Commission's standard contractual clauses, and Microsoft Ireland Operations Limited, which provides our email and document storage within the European Union. Each provider acts under a written data processing agreement.

How long we keep it

Enquiries that do not lead to an instruction are kept for twelve months and then deleted. Client files are kept for the period required by the Law Society and by the Statute of Limitations, which is generally seven years from the end of the matter and longer for property, probate and trust matters, and are then destroyed securely.

Your rights

You have the right to ask for a copy of the personal data we hold about you, to have inaccurate data corrected, to have data erased where there is no longer a lawful basis for keeping it, to restrict or object to processing in certain circumstances, and to receive data you have given us in a portable form. Some of these rights are limited by legal professional privilege and by our obligations to retain records. To exercise any of them, write to info@reb.ie.

If you are unhappy with how we have handled your data you may complain to the Data Protection Commission, 6 Pembroke Row, Dublin 2, D02 X963, www.dataprotection.ie.
