Commercial Insolvency & Restructuring

We advise creditors, directors, liquidators and receivers through the insolvency of Irish companies, from the first demand to the final distribution.

For creditors, the work is about recovery. We serve statutory demands, present winding up petitions, support or oppose the appointment of liquidators and provisional liquidators, and pursue the enforcement of judgments and security against companies and the individuals behind them. Where a debtor's assets have been moved or dissipated, we act quickly to trace and secure them.

For directors, the work is about exposure. We advise on the duties that arise as a company approaches insolvency, respond to a liquidator's queries and to restriction and disqualification applications under Part 14 of the Companies Act 2014, and defend proceedings brought against directors personally. Much of this work turns on what was done and recorded in the months before the company failed, and early advice makes a material difference.

We also act in examinerships, receiverships and members' voluntary liquidations, and in the restoration of companies struck off the register. The firm's litigation and insolvency work overlap constantly, and the same solicitors handle both so that nothing is lost between them.
